COMMISSION PROCESS
I go by a slotting model to avoid request bombs and/or burnout. Here's a breakdown of my commission process for newcomers.1. Announcing Slot Availability
I will publicly announce if slots are open via Instagram story. I will announce a time for when slots open, stories are typically posted 3-5 hours prior.2. Sending requests
When the time comes, you must send an Instagram DM to claim a slot. I will let you know if you caught a slot or not. Once all slots are taken, I will announce it via Instagram story.3. Payment
I only accept to be payed full price first. If unable to pay upfront, I may be able to negotiate depending on your circumstances.
I only accept PayPal or E-transfer as a valid method of payment4. Rough draft/revisions
I will reach out to you with a rough draft of your order. I provide unlimited revisions, meaning I will workshop with you until satisfaction is completely met.5. Final product
I will ask for an email to send over the final product in high quality, along with any extra assets.Note: Order privileges will be given to potential clients with higher budget estimates, meaning you do not need to wait for a slot. TERMS OF SERVICE (TOS)
This disclaimer is intended to ensure a clear understanding between Sammyfendi (“the Artist”), the individual or entity commissioning services from the Artist (“the Client”) and the final product provided to the Client ("the Work").Purpose and Agreement
By commissioning, purchasing, or otherwise engaging in artistic services provided by the Artist, you (the Client) acknowledge that you have read, understood, and agree to be bound by the following Terms of Service. These terms establish a legally binding agreement between both parties.Artistic Expression
The Artist provides original, creative work that reflects their unique style and interpretation. While the Artist will make reasonable efforts to accommodate the Client’s vision and preferences, artistic freedom remains at the core of the creation process. The Artist reserves the right to determine the final composition, style, and presentation of any commissioned artwork within the scope of the agreed-upon concept.Services Offered
The Artist offers a range of visual art services, including but not limited to:
a) Illustration
b) Digital art
c) Cartooning
d) Painting and Design
All services are subject to availability. The Artist reserves the right to accept, reject, or discontinue any commission at their sole discretion.Subject Matter Restrictions
The Artist will not create content containing or promoting:
a) Pornographic material (including explicit sexual acts or penetration)
b) Hate speech, discrimination, or defamatory content
c) Excessive violence, gore, or brutality
d) Any subject matter the Artist deems unethical, unlawful, or contrary to personal values
The Artist reserves the right to decline any project at any time for any reason.Age Verification for Mature Content
If a Client requests artwork containing mature (18+) themes:
a) The Client must be 18 years of age or older.
b) The Artist may request valid photo identification showing full name, face and date of birth (e.g., driver’s license, passport, or other government ID).
c) Failure to provide valid ID upon request will result in refusal of the commission.Communication and Client Agreement
Before any work begins, the Artist and Client will discuss the project scope, artistic direction, deadlines, and deliverables. All agreements must be documented in writing (email, chat, or signed contract) and acknowledged by both parties. Once terms are agreed upon, the Client is responsible for providing all required references and information in a timely manner.Payment terms
Payment must be made through approved and secure methods (e.g., PayPal, bank transfer, etc.). Failure to complete payment may result in cancellation of the project and forfeiture of rights to the artwork.Revisions
Revisions are permitted during the draft stage, within reasonable limits. Major changes outside the original scope or after final approval may incur additional fees. Excessive or repeated revisions may be declined or billed.Cancellation and Refund Policy
The Artist reserves the right to cancel a commission for any reason (e.g., breach of TOS, harassment, or inappropriate conduct). If the Client cancels after work has begun, the deposit will not be refunded, and partial payment may be required for work completed. Refunds will not be issued once the final artwork has been delivered.Copyright and Usage rights
The Artist retains full copyright and moral rights to all created artwork unless explicitly transferred in writing. The Client receives a license for personal use only unless otherwise agreed (e.g., for commercial use). The Client may not reproduce, resell, modify, or distribute the artwork without written permission from the Artist. The Artist reserves the right to display, post, and include the artwork in portfolios, promotions, and social media unless confidentiality is requested in writing.Use of AI
The Client agrees that the Work, in whole or in part, shall not be used to train, develop, or otherwise be input into any artificial intelligence (AI) systems, machine learning models, or automated data tools. They shall not authorize any third party to use the Work for such purposes. A violation of this clause, shall be deemed a material breach.Liability and Indemnification
The Artist is not liable for:
a) Losses, damages, or dissatisfaction arising from interpretation, use, or display of the artwork.
b) Any indirect, incidental, or consequential damages related to the artwork or services.
By commissioning the Artist, the Client agrees to indemnify and hold harmless the Artist against any claims, damages, or expenses arising from the use of the commissioned work.Legal Action and Misrepresentation
If a Client misrepresents their identity, age, or the nature of the requested content; or attempts to coerce, deceive, or violate these Terms, the Artist reserves the right to:
a) Refuse or terminate the commission immediately; and
b) Pursue legal remedies including but not limited to damages, injunctive relief, or attorney’s fees.By engaging in any commission, communication, or payment with the Artist, the Client confirms that they have read, understood, and agreed to these Terms of Service.
